The District Court represents the judicial branch. B. What is the difference between a civil and criminal case? (give specific examples) A civil case is usually introduced by private individuals or corporations wanting to collect money owed or reimbursement for damaged property. For example, if two drivers are involved in an accident and one driver received an injury from the accident, the injured driver can file a civil case against the other driver and sue for medical bills. In contrast, a criminal case is usually introduced by the local, state, or federal government in response to a violation of the law with hopes of achieving a conviction, fine, and/or jail time. For instance, if someone was driving drunk, the state would file criminal charges against the drunk driver and if convicted they would receive a sentence. C. What is the difference in cases between municipal, state, and federal courts. (give an example of a case that would be tried at municipal court, state court, and federal court. A municipal court only can listen to cases within their specific municipal, county, community, or city. Usually, municipal courts hears cases involving misdemeanors, one year in county jail or less, like driving citations. A state court can only listen to cases within the state. Most times state courts listen to a variety of cases including most criminal and contract cases as well as probate--wills and estates, personal injury, marriage, divorce, and adoption cases. A federal court can listen to any case within the United States; however, the federal court only listen to cases that involve the constitutionality of the law. Additionally, federal courts listen to cases involving the laws and treaties of the United States, cases involving ambassadors and public ministers, disputes between two states, admiralty law, bankruptcy, and habeas corpus issues. D. What is the difference between original and appellate jurisdiction? Original jurisdiction is a court that has the power to listen to a case the first time while appellate jurisdiction is a court that has the power to review a lower court's decision. |
